California gives annuity buyers a protection most states do not. If you are 60 or older, state law hands you a full 30 days to read the contract at home and send it back for a refund of everything you paid. That single rule changes how you should approach annuities in California, because it means no decision has to be made in the room. The 30 Day Free Look Is Your Best Tool

Under California Insurance Code section 10127.10, buyers age 60 and older get a 30 day free look on an individual deferred annuity or life policy. Return the contract inside that window and you get every dollar of premium back. No reason required. The California Department of Insurance spells this out in its guide for senior annuity buyers, along with the exact refund language your contract has to carry.

Use it. Take the contract home, read the surrender charge schedule, and have a family member or your CPA read it too. Any agent who discourages that is telling you something useful about themselves.

What The California Guaranty Association Covers

If a carrier licensed in California fails, the California Life and Health Insurance Guarantee Association may step in. For annuities the protection is generally the lesser of 80 percent of the contractual obligation or $250,000 in present value per contract owner per company, and it applies to the fixed and guaranteed portion.

That 80 percent piece catches people off guard. On a $250,000 contract the practical ceiling is $200,000, not the headline number. California Adds Its Own Tax On Early Withdrawals

Most people know about the federal 10 percent additional tax on distributions taken before age 59 and a half. California stacks its own tax on top. The state applies an additional 2.5 percent to the taxable portion of an early distribution from a qualified plan, IRA, annuity, or modified endowment contract, reported on Form FTB 3805P. The rules and exceptions are published by the California Franchise Tax Board.

California also has no special exclusion for retirement income at the state level, so annuity payments generally land in ordinary income. Between that and the early distribution tax, the timing of when you turn on income matters more here than it does in a state with a retirement income subtraction. Have your tax preparer run the year you plan to start payments before you commit.

Rules That Protect You At The Door

California regulates in home annuity meetings more tightly than most states. An agent has to give 24 hour written notice before coming to your home, state up front that the visit concerns insurance, name the company they represent, and identify everyone who will be present. You can ask anyone to leave at any time.

California also holds anyone offering an annuity to a buyer 65 or older to a duty of honesty, good faith, and fair dealing. The practical version of that: you should leave every meeting understanding the surrender schedule, what happens to the money if you die before payments start, and how the agent is paid.
