Indexed universal life insurance in Florida is often explained to residents using arguments borrowed from other states, so it is worth separating what applies here from what does not. Florida has no personal income tax, which removes one of the arguments that carries weight in California or New York. What Florida does give a policy owner is unusually strong protection for the money inside the contract, and a household budget that swings harder year to year than almost anywhere else in the country. Both facts should shape how the policy is funded.

The Tax Argument Is Weaker Here Than The Brochures Suggest

National articles about indexed universal life lean on tax deferred growth. That argument is strongest for someone paying a double digit state income tax on top of the federal schedule. Florida residents pay no state income tax on wages, retirement income, or investment gains, so the state layer of that benefit simply is not there.

The federal side still stands. Growth is generally not taxed as it accumulates, policy loans are generally not taxable events when the contract is structured and managed correctly, and the death benefit generally passes income tax free. Those are the same benefits a resident of any state gets.

That changes who the product fits. In Florida the reason to own one of these is rarely a state tax savings. It is permanent coverage, a floor under the crediting, and protected liquidity.

Florida Protects Cash Value Without A Dollar Cap

This is the part that genuinely favors Florida. Under section 222.14 of the Florida Statutes, the cash surrender value of a life insurance policy issued on the life of a Florida citizen or resident is exempt from attachment, garnishment, and legal process by that person's creditors. There is no dollar ceiling written into it, and the exemption covers indexed universal life the same way it covers whole life. Florida courts have generally read the statute broadly.

Compare that to California, where the exemption for the loan value of unmatured policies stops at a set dollar amount. A Florida physician or contractor can hold a meaningful cash value position and have it treated very differently from the same balance in a taxable brokerage account. It deserves a second look here, because Florida households absorb cost shocks other states rarely see. Property insurance renewals, condominium reserve assessments, and hurricane deductibles land in lump sums with little notice.

A policy that depends on consistent funding is exactly what people skip in a year like that. Cost of insurance charges keep coming out of cash value, and a policy illustrated on a level premium can drift toward a much larger required payment later, or toward a lapse.
