Michigan is one of the friendlier states in the country for keeping what you have already saved, and that changes how indexed universal life insurance in Michigan should be presented to you. The state runs a single flat income tax rate instead of a graduated one, it charges no estate or inheritance tax, and as of tax year 2026 the retirement income deduction is fully restored under the Lowering MI Costs Plan. Three of the arguments you will hear most often for an IUL are weaker here than in a high tax state. One argument is considerably stronger.

A Flat Tax Changes The Deferral Argument

In a state with graduated brackets, the argument writes itself: defer income now while you are in the top bracket, take it later when you are not. Michigan does not work that way. The state applies one flat rate to taxable income no matter what you earn, so a dollar of growth deferred to your sixties faces roughly the same Michigan rate it would face today. Confirm the current rate with the Michigan Department of Treasury before anyone builds a projection around it.

That does not make the tax treatment worthless. Tax deferred accumulation, generally tax free access through properly structured policy loans, and an income tax free death benefit are all federal features, and a Michigan resident gets them in full. It does mean the honest version of the story rests on federal treatment rather than on a state bracket you are supposedly escaping.

The 2026 Retirement Deduction Is Real, And It Matters Here

The 2023 Lowering MI Costs Plan phased the pre-2012 retirement income exemption back in over four years, reaching full restoration in tax year 2026. Social Security is exempt from Michigan income tax as well. For many households that means pension and qualified plan withdrawals are treated far better at the state level than they were a few years ago.

Read that as good news, and then read it as a caution. If someone shows you an illustration arguing that your 401(k) is a state tax trap in Michigan, the argument has aged out. The reasons to add a policy here are federal tax treatment, control over the timing of income, protection that does not expire, and the creditor question below. Ask any agent to make the case on those grounds, and confirm your own deduction with a Michigan tax preparer, because eligibility still depends on birth year and filing situation.

Michigan Protects Cash Value Unusually Clearly

This is where Michigan stands out. Many states protect life insurance proceeds while leaving the living cash value in a gray zone. Michigan does not. Under MCL 500.2207, proceeds of a life insurance policy payable to a spouse, children, or a trustee for their benefit, including the cash value, are exempt from execution and from liability to creditors of the insured. Subsection 2 extends the same treatment where a beneficiary other than the insured is named.

Michigan courts have applied that language to living cash value, not only to a death claim. For a business owner, a physician, a contractor, or anyone else carrying professional exposure, that is a genuine planning feature and worth raising with a Michigan attorney before the application is written, since the protection turns on ownership and beneficiary structure.

Two limits belong in the same breath. The exemption does not shield the policy from claims brought by or on behalf of the insured, and it does not protect premiums paid to defraud existing creditors. Nobody should treat a policy as a way to outrun a judgment that already exists.

What Michigan Does Not Tax

Michigan levies no state estate tax and no inheritance tax. That removes a planning problem families face in Illinois or Washington, where a state exclusion far below the federal threshold pulls ordinary households into estate tax territory. Michigan heirs are dealing with federal rules only.

What Michigan families still face is liquidity. A cottage up north, a family business, farmland in the Thumb, rental property in Grand Rapids. These are assets nobody wants to unload on a deadline. A death benefit arrives quickly and in cash, which is often the reason it belongs in the plan even when no tax is owed.
