Ohio repealed its own estate tax for deaths on or after January 1, 2013, and the state has no inheritance tax. That removed a real bill for a lot of families here. What it did not remove is the practical problem: when a parent dies, someone still has to pay the final expenses, keep the operating account funded, and often buy out a sibling who wants nothing to do with the shop or the ground.

Ohio Law Is Good to Life Insurance

Ohio protects life insurance more broadly than many people expect. Under section 3911.10 of the Ohio Revised Code, contracts of life insurance and annuities taken out for the benefit of a spouse, children, or dependents are held free from the claims of the insured person's creditors, along with the proceeds and avails of those contracts.

Courts have generally read "avails" to include cash surrender value while the insured is living, which matters for a business owner or a physician who wants a stable place for capital. Protection still depends on ownership, on the beneficiary designation, and on timing, and federal bankruptcy rules run on a separate track. Treat it as a strong reason to structure the policy carefully with an attorney, not as a blanket shield.
